US court to decide on the legal status of mod-chips

I’m sorry for the lack of updates, but a very persistent case of pneumonia has kept me out of the ballgame. 


However. Today Wired has a story about a lawsuit against Matthew Crippen charged with violating the anti-circumvention article in the DMCA. The lawsuit starts today and has an interesting twist in that the court has decided that “fair use” cannot be raised during the trial. The lawsuit is the first of its kind. 


A funny thing is that the case is being brought by the federal government and not the right owners. The same is actually the case in Denmark to my surprise, I haven´t see that rule used in Danish courts.
