Robot inventors

On Patent baristas there was a post the other that the caught my eye.

Stephen Albainy-Jenei (and guests) asks “What if a robot makes an invention?” He gives an example from Science, where a robot reportedly developed and testes a biological thesis and discovered a new gene sequence.

One of my favorite subjects in copyright law was always non humans as creators (eg. monkeys or computers). In european copyright law there is a human requirement so the idea of robot inventors intrigued me.

Stephen concludes that inventions made by robost could face problems in the US but not nessecarily in Europe. In US patentlaw there is a reference to a person inventing something where in Europe aperson or legal entity is entitled to apply for a patent. Very good point indeed.

I would argue that the person programming the logic of the robot is entitled to all inventions made by that robot.

It Turns out that The Invent Blog also had a post on robot inventors citing a FT.com article as inspiration. Robots are the latest patent craze it seems.
