Patentcase decided after 28 years in the courts

Ever since I got into the IP business I have been hearing and following the so called “Amstrup-case”. Today the Danish Supreme Court gave the final verdict in the infringement case which has lasted 28 years.

An independent inventor has fought with the gigant Dat-Schaub for 28 years claiming that the company was infringing his patent. Unfortunately for Mr. Amstrup The SupremeCourt did not agree and Mr. Amstrup lost the case.

It is an exceptional case which has been thrugh all instances both administrative and in the courts. The question is whether Mr. Amstrup should have settled (and if he was given the option)?
